If it is established as a creature of law, then it is de facto part of the government, and if it does ANYTHING, that falls under the authority of the Executive. Congress does not have power to create any agency extraneous to the Constitution. That was the whole problem with USAID: Congress creating ad hoc agencies to do its bidding outside of Article 2 of the Constitution.
