The grassroots pushback is tremendous and that's what ABC-D is acting on, plus his tanking ratings, but there's no evidence that he made a materially false statement, and I don't see anyone arguing the logic proving that his statement was sufficiently direct to be actionable. Instead everyone I've seen assumes this formulation was a lie from the start. Give one minor credit to Kimmel's lawyers for prepping him this way, and then let the chips fall where they may.
