I do remember that case "Public use clause" ruling went 5-4 in favor of city.
Though it sort of backfired on eminent domain supporters, leading over 40 states to enact reforms limiting eminent domain for economic development; the New London project ultimately failed due to lack of funding.
This is encouraging but I'm also reminded of Kelo v. City of New London. Dig into it if you don't know what I'm talking about.
