It's worth pointing out that this challenge is to Trump's imposing these tariffs under emergency conditions. If he loses, he can reimpose them under Section 232 authority like in his first term. Bessent said they've already drawn up Section 232 reports for many of the countries.

Why not just use section 232 in the first place? Is there a big downside? I had heard that there are caps, time limits, and more rules
I’m not sure.
Edit - I read elsewhere that Trump did it this way to stop transshipments from China.
