Is this the kind of thing that he has the authority to do without congressional approval because of emergency powers? I mean, we all certainly want it to be this simple.

I am assuming some of it is within the power of the executive but the singing off on the selection of a SC justice is something that will be hotly debated if it was due to autopen.
