Though he was the firstborn, his birthright was given to the sons of Joseph son of Israel, because Reuben defiled his father’s bed. So he is not reckoned according to birthright. 2And though Judah prevailed over his brothers and a ruler came from him, the birthright belonged to Joseph."
So the scepter (right to rule) was given to Judah by Jacob (Israel), but the birthright (right to carry the name) was given to the tribes of Joseph. Only when they are united can a king from the line of Judah legitimately rule the nation called Israel. You see this in after Solomon - the northern nations (Israel) split from Judah - but the north kept the name Israel and Judah was called... Judah.
And when the modern state of Israel was created, Judah/Edom stole the name Israel back from Jacob, taking it illegitimately.
Thus Jacob's deceit reaped a long term harvest in kind.
