Whether the individual pulled out the gun or not, it's not going to matter legally. Due to the fact that it was a charged environment (like it has been and will continue to be) with "observers" needlessly inserting themselves in ongoing law enforcement functions, it's going to be considered a "good shoot."
I kept reading comments saying that an officer pulled the gun out of his waistband before the others officers shot him. Once again...it doesn't matter. If the idiot thought it was a good idea to interfere during an obvious law enforcement function, the officers were never going to wait to "not" shoot once they found out he had a gun on him (legally carrying or not)....especially if it's a split-second decision.
It's like saying that if a war is going on between two factions and I run out into the middle of it with an airsoft gun pointing it at either faction....that I shouldn't expect to be shot. Of course I'm going to be shot!
Objective Reasonableness Standard all day, every day and twice on Sundays.
58-61 second mark officer to the right crouched down appears to pull what looks like a gun out.
60-63 second mark, officer to the left (dark head wrap) pulls his pistol steps to the side and shoots at the 62 second mark
two things happening simultaneously very quickly. looks like a gun is pulled away on the right side and on the left side almost simultaneously an officer shoots. literally a second apart.
slide the scrubber starting at the 58 second mark and slowly move back and forth up to the 63 second mark and focus to the right then do again focusing on the left.
