Excellent article!!!! Let me add a couple things. The IEEPA let Trump wheel and deal without restrictions of the other statutes. Then he just changed statutes. Trump, after the ruling, used 122 to put a 10% tariff on. But then in a power move upped it to 15%. So the weight adjusted tariffs are likely now 17% again. Funny how that works.
When he said this decision would give cover to coming decisions, I immediately thought of BC, he does get to that toward the end. Yes, the democrats were all crowing about how legitimate this SC is because of this decision. Wait until birthright citizenship is said to be valid for only current citizens. It's getting good. 😁😂

I mean, people are saying it was a plan B, but I prefer to think of it as a SC audit of new policy, where the auditor suggests (with 9 authoritative voices), improvements to a system. And a subsequent corrective action that sharpens and clarifies the policy.
This proves that tariffs are not a tax. If they were, Democrats would love them!
