I just don't buy this. Constitutionally he can waltz in and assume the presiding chair. However - he doesn't even get a vote unless as a tie-breaker. Besides - once he gets up and leaves the Senate Majority Leader can just undo what was done, or even adjourn the Senate.
If this was attempted it would likely be political suicide. The left would immediately impeach JD in the house, and the Senate would convict him. There are a ton of RINOs that would absolutely see that as a huge power grab - in fact it would be a cross-branch constitutional crisis.
There is one other thing everyone is forgetting. The Senators could simply break quorum and leave. Like the Demons like to do in Texas.
