The following Saturday morning, Justice Scalia failed to appear for breakfast at a weekend hunting retreat in Texas. Hours later he was found dead. As far as the public record reveals, the vote on the Clean Power Plan was his last. Had the court not acted with exceptional speed, the case would have ended in a deadlock and the Obama plan would have stayed in place.
What else is the Court supposed to do when there's a perpetually gridlocked Congress and Senate, along with a corrupt lower Court Judiciary. The Supremes are supposed to be in charge of the District and Appelate Courts, each with their own district to manage. Yet, that's not what we've seen happen, especially over the last 20-25 yrs. They're suppose to keep the lower courts in check by ensuring they only operate inside their constitutional authorities, but by letting these activist judges run rampant and roughshod over the U.S. Constitution and U.S. Code, they've effectively shown themselves to be neutered and weak.
