The judge heard about this and was required to have a hearing afterwards, to determine what this juror was thinking, or if she had contaminated the entire jury. Let's say Tina peters is vindicated and she is freed. Then she sues the people that sent her to jail. If she wins those cases where does the financial reward come from? Do the bad actors pay out of their own pockets or since they were public officials will the burden rest upon the shoulders of the tax payers?
It depends on whether she would sue the government officials in their personal or official capacities.
There was a case where a law enforcement officer was transporting a girl, and somehow he ended up inside her. The court decided that rape was outside the scope of his job. Government officials are not employed to commit crimes.
If they are sued personally, they have to pay their own lawyers😁
I think the prosecutor would have immunity as a government official, but ifshe can get a finding of innocence (and eventually Colorado better get her this finding) then she could get compensation - Colorado Exoneration Act
