You’re right. Create the precedence for constitutionality by forcing them to fight against a possible unconstitutional lawsuit from the President. Then when there is an unconstitutional State attempt there’s precedence that kills their attempt at the law.
Where does the US Constitution come into play here? Can the local.leaders just push our founding documents aside and do what they feel is the right thing to do, at the time? Wait until conservatives get into office and begin doing this exact same thing. Oh, the howls from the left will be loud and continuous. They will be saying, "They are tossing the US Constitution away!"
