A few issues with this. That location is the intersection of two shipping lanes... and it appears to be standard movement. If you watch that website for 30 minutes- all of those ships are moving through that location. They are not sitting in that spot. If they really didn’t want to be seen there they would turn off their transponder completely.

you're making a pretty huge error in taking the dissent as fact. Almost every single decision that SCOTUS makes, there is a dissent in the opposite direction. If we start taking dissents as fact - then the court doesn't have any meaning and no side actually prevails.
