Also, the Insurrection Act has been invoked for far less over the decades. If it was used to quell riots in LA, desegregate schools in the 60's, and to help hurricane victims, it can certainly be used to stop what is happening.
You may be right. The military usually holds tribunals to prosecute military criminals though, not regular citizens. That's where the Act would have to be invoked so they could prosecute and possibly execute criminals from all walks of life.
The definition is vague, so even someone that's "linked" to a criminal can be designated an enemy combatant. The description I saw talked about how, let's say you donated money to an orphanage in Afghanistan, and it turned out that someone working there was the brother's cousin's sister of a suspected terrorist. You, by donating money, could be designated an enemy combatant and thus possibly sent to Gitmo where they could legally use torture to extract a confession out of you, guilty or not. This is what was done after 9/11, and this is why it's been controversial.
