Well hasn’t the USA been at a state of war since 2001 - the war on terror? Iirc Bush did declare war legally?

Yes, absolutely. It is my understanding that the United States has been under a formally declared state of war since 9/13/2001.

As others pointed out; sure the Iraq war came & went, but the "Global War On Terror" is I believe the impetus for keeping us in a declared state of war.
