Both states are going to pass legislation that would invalidate unconstitutional EO's from Biden. This should also apply to acts of Congress that are a violation of the Constitution.
States have this power. Thomas Jefferson advocated for it.
Hopefully, this is the start of something great.
that's the thing that annoys me about the way we fight back sometimes, if it's unconstitutional...you don't need to pass any legislation to invalidate these EO's...they we're invalidated the second they came into existence, they hold no power of law and no one has any duty to enforce them. The state legislatures and the governors should just release a statement saying "hey these EO's are unconstitutional and hold no power of law, anybody caught enforcing them will be thrown in jail" case closed.
The problem is, the state has to have a system in which they can do that. What if the governor says one thing, the AG says something else, and the House Speaker says something different?
They have to have some sort of legal process which would make it "official state policy" that such and such EO is unconstitutional.
That's what this legislation is doing.
That's what they're doing. Consider these actions merely as "putting it on the record."
