I've come to the conclusion that the Texas case last fall was designed to be thrown out for this exact reason (also to prove Gorsuch, Kav and ACB's independence from Trump). It was a preemptive move in the event that Cali+NY or the Feds try to interfere with the other states as this process unfolds.
