It is! What they are saying is a blatant lie! Health Inspectors are prohibited from asking what “medical condition” people have if they require a special accommodation or have a service animal in a business.
Exactly the question to ask. These people are just stating what they HOPE is true. I believe the language in HIPAA is quite clear and it's also my understanding that this was a law passed by Congress. So I don't believe (not a lawyer) that even a gov't organization can change this without congressional action.
I would not enter any business that required my medical history. It is a violation of my privacy. It doesn't matter to me if it isn't illegal, I will never patronize that establishment every again. Even after this is all done, I would never give them my business. Ignorance is no defense, violating my rights will not be forgotten nor forgiven.

Basically it says your doctor & insurance company can’t share your medical records without your consent. It doesn’t prohibit anyone from ASKING for your medical information, or refusing to serve you if you don’t answer or won’t provide proof. Some state statutes do what folks wish HIPAA did, but HIPAA doesn’t.
