If the 6th Circuit vacates the 5th Circuit's stay, and the en banc court splits 8-8, then the Supreme Court will have to decide this case quickly.
This is going to the Supreme Court.
My thoughts on this is the 6th Court purposely created this condition to pass this up to SCOTUS to hear this.
This is fucked because for one the 6th Circuit is suppose to be conservative and they removed the stay on OSHA. The question is how is SCOTUS going to rule on this? I don't see how OSHA can by bypass the legislature and usurp power. If OSHA is able to do this, where does it stop in terms of work place safety. STD vaccinations? How many vaccinations can anyone think of? Is OSHA now able to dictate conversations in the work place? For safety concerns there will be no discussion on sports and politics, or even excessive corporate red tape?
The 11th circuit ruled on the federal contractor one so technically different. Good chance this could go to the Supreme Court but I don't have high hopes of the end result being good.
They love that 800k number but what other disease do they add year after year 500 thousand a year die from heart disease 5 million in 10 years yet they don’t give that medication for free
you don't need a court to tell you you don't comply, say you wont comply.

Not happy at all. Hopefully the SCOTUS rules are way, or else things will get very ugly.
If two circuits disagree does it automatically go to Supreme to settle?

It’s irrelevant what a court decides. You must make your own decision and live or die by it.
