With the 6th Circuit vacating the 5th Circuit's stay, and the en banc court splits 8-8, then the Supreme Court will have to decide this case quickly.
In other words, this is going to the Supreme Court.
My thoughts on this is the 6th Court purposely created this condition to pass this up to SCOTUS to hear this.
This is fucked because for one the 6th Circuit is suppose to be conservative and they removed the stay on OSHA. The question is how is SCOTUS going to rule on this? I don't see how OSHA can by bypass the legislature and usurp power. If OSHA is able to do this, where does it stop in terms of work place safety. STD vaccinations? How many vaccinations can anyone think of?

SCOTUS will not rule in our favor. People (and businesses) needs to not comply. If that happens there "mandate" will fall flat.
I don’t have much faith in SCOTUS at this point.
Mt wife just received her religious exemption. The form she is supposed to sign is an understanding that the company has the right to change its policy when the federal lawsuits are decide.
She will not take this vaxxine, period. OSHA does not get to usurp power here. We are f*ed if OSHA is allowed to do this.

This is for the OSHA EO to publish 'COVID' vaccination guidleines under the Emergency Temporary Standard (ETS). There is still religious exemptions.
That's not how exemptions work and the will lose in court.

I don’t understand. How does the 6th have authority to override the 5th? I thought only Supreme Court could do so.
