It's been shown that capital punishment is not a deterrent to crime. Neither are mandatory minimum sentencing. Criminals gonna crime, that's just how it goes.

Because toppling statues was more of a "fad" than anything else. There is no long-standing derangement of the populace to topple statues.

Good points. What is the standard of proof? Made up charges happen like you point out political motives or whatever.
