While a pardon might keep the son and brother out of jail, it could be devastating for their associates, including “sleepy joe”. Without a pardon, they can’t be forced to testify but a pardon would remove the 5th amendment protections and they could be forced to testify about everything and everyone they have been involved with. They would still have civil liability for all their I’ll gotten gains and would pose a real threat to some very unsavory associates. In some ways, a pardon could be thought of as a death sentence.
Without 5th amendment protections they still don't have to answer anything. What are they going to do? Charge them with obstruction in a Federal court? Which then also gets pardoned. They can do this all day.

You can not pardon crimes in progress. Only completed crimes can be given a pardon and these crimes are ongoing.
