I hoped this wasn't going to happen. Earlier, I posted my concerns that this Obama judge was reenacting the same playbook as Judge Emmet Sullivan with General Flynn.
"If the judge ruled in favor of Durham, why does the judge still need to review them to determine if they are "privileged"? I Thought the entire argument over GPS Fusion was whether they were attorney-client; therefore "privileged". The judge ruled stating they are not privileged. So, why is the judge still involved?
I know this is a Obama appointed judge. Is this starting to look like a reenactment of Judge Emmet Sullivan's shenanigan's with General Flynn?"
We'll see what Durham does with it. The judge decided to rule on the specific charge, and not the conspiracy. It will make the Sussman case go faster.
Durham's previous indictments were part of the same conspiracy, but Sussman was charged separately when his time came. I see no reason why that can't happen the same way with Joffe and, when the time comes, Hillary and Obama.
My concern is why doesn't Durham have the same latitude and power as Mueller did? Remember they used the U.S. Attorney's Office for the Southern District of New York to raid Trump's lawyer Michael Cohen. This was during Trump's presidency. Stephen Ryan, Cohen's lawyer, said in a statement. "I have been advised by federal prosecutors that the New York action is, in part, a referral by the Office of Special Counsel, Robert Mueller." Ryan called the search "completely inappropriate and unnecessary" and said authorities had seized "protected attorney client communications between a lawyer and his clients." He added that Cohen had previously cooperated with government investigations, including in Congress. McClatchy reported last week that Mueller was looking into Cohen and the Trump Organization. Cohen was involved in overseas business deals, the report said.
Durham is investigating the exact same thing, but as a fraud. Why doesn't Durham have the same latitude as Mueller? The answer is obvious -- Judge Cooper is another biased Judge like Emmitt Sullivan was.
If the judge initially ruled in favor of Durham, why does the judge still need to review the the Fusion GPS documents to determine if they are "privileged? Didn't Cooper just rule they are not privileged? Why are the Fusion GPS subpoenaed documents viewed by 'court camera'? This suggests this Judge is throttling the investigation. They should have been sent to Durham carte blanche for his review.
