That's not entirely true. The code is kind of up for interpretation, but it does not state at all that you have to be convicted, it just says if you have taken classified documents and not returned them and they are found in your possession that you're violating 18-2071.
Congress tried to use this to bar Killary from running for president, but congressional scholars argued against it at the time and that was accepted.

Codes are written by bureaucrats. Most likely congress never adopted these rules. Even that being said was true all laws written by government institutions when in conflict with the constitution the constitution takes precedence.

Hillary was not a President, or former President. Presidents and former Presidents have a significantly higher level of discretion over possession of classified documents, especially since a President has the authority to classify a document as "top secret".
Presidents do, former presidents do not. They have a security clearance, but not the ability to declassify.
