Last sentence from quote of law in Elias tweet says law does not apply to retired members of the armed forces. Wouldn't the former Commander-in- Chief count as a "retired member of the armed forces"?
The CiC is a civilian role. The Supreme Court ruled in Youngstown Sheet & Tube Co. v. Sawyer (1952) that having a civilian role "ensures civilian superintendence over the military—and, as such, the subordination of the military to civilian (and democratically accountable) control."
