In truth, the DoJ did charge Steve Bannon and a court did find Bannon guilty of contempt. This same court stripped Bannon of defending himself, just as we have seen in many other cases (Roger Stone, Manafort, General Flynn, et. al.). It's a star chamber court that consistently ignores the 'Fruit of the poison tree' legal doctrine.
"Contempt of Congress" is political magick. Congress cannot give itself judicial authority. The statutory law in question, is unconstitutional, and thus Bannon committed no crime.
However, this isn't how it worked. The show trial of the J6 committee made a referral to the corrupt DoJ, who then made the charge and filed it in court with a corrupt judge. The judge stripped Bannon of any legal defense. It was a star chamber.
Yes. But my point is the the committee's referral ("contempt of Congress") itself, holds no legal weight for the DoJ to prosecute because there is no such crime of "contempt of Congress", at least not in the way it's being misapplied.
Originally, "contempt of Congress" was dealing with OBSTRUCTION of Congress doing their work, specifically bribery. The work of Congress doesn't involve "investigations" against private citizens. Even if they argue that Bannon's testimony was critical for an investigation against Trump, unless this is just a never-ending impeachment effort, then there's nothing for Congress to be involved with as far as "investigations", which is the work of the judiciary, not the legislature.
Watkins v. United States was nonsense. Note the chief justice and majority opinion author... Earl Warren. Go figure... Wilkinson v. United States ruled that Congressional investigations must pursue "a valid legislative purpose", which obviously in this case with Bannon/Trump, there isn't any.
The whole thing is bullshit theatre. As people keep realizing how much of a joke our system is, hopefully that means the masses won't put up with it anymore.
Not holding congress in contempt (these days) is to aid and abet sedition and in some cases treason.
