I don't see why MZ would go to prison over it, unless it came out that he was ordering his employees to do it. And I haven't seen anything anywhere saying that he has.
This is on par with employees in shops and restaurants selling your CC numbers. CEOs of those companies don't go to prison for their employees mistakes.
He could be held liable if he did not put appropriate safeguards in place or allowed access to sensitive information open and unmasked where anyone, even the janitorial staff could see it and steal it, which apparently some of them did...

To be criminal I think they would have to prove criminal intent to allow this to happen. Otherwise its civil.
