The SEC has an almost identical control structure as The Fed, which is not surprising since the person who wrote the bill to create the SEC was also the person who wrote the Federal Reserve Act (Carter Glass). The SEC is thus privately controlled.
However, it is funded by the government AKA the taxpayer AKA you and me. "Suing the SEC" would be stealing from Mary to pay Paul so he can give some money to Peter, none of whom are complicit in the actual crime.
