Those foreigners are subject to the jurisdiction of their home nations. As is their offspring. Until thy go through the citizenship application and process.

Look up "birth tourism". There is an entire industry of getting pregnant women to the US in order for them to give birth here so that their child can be a US citizen.
Trump worked to make it more difficult for pregnant women to get a tourist visa because of birth tourism.
