That was my gut reaction as well. Then I thought about it.
Who would be responsible for admitting people into the asylums? Who here doesn't think that would absolutely be abused and used against people the government wants to silence (like us)? Red Flag Laws are a good example.
Careful what you wish for. FISA isn't the only thing that goes both ways.
Yes abuse is a risk. Every solution to this problem has risks and pros and cons. But if you refuse to do absolutely anything because a solution might be abused. Then you don’t help anyone or solve anything. You just let the problem fester.
People like Neely either need or in his case needed help. Or at the very least somewhere to go that’s relatively safe for both them and the general public.
It’s a difficult question and situation. As you said there’s the potential for abuse in a solution. But the alternative is to let the problem continue to fester. Which frankly isn’t a tenable solution either. Barring a miracle cure for all mental illness. You aren’t going to have a solution to this issue that doesn’t have the potential for abuse in some fashion.
You might succeed in kicking the can down the road some. But someone will inevitably need to deal with the problem eventually.
I agree with you and the idea we need the asylums again. But - only with safeguards, and not like the red-flag "safeguards". If someone is being committed against their will the time to take it before a judge is before they are committed - not after like with the gun laws. Then put another provision into the law that states after 14 days or 1 month the person is to be reevaluated by a 3rd party - not the person or people that committed them.
Penalties for abusing this should be at least a loss of medical license and 10 years in prison, as well as a suitable fine paid to the victim as reparations.
While we're at it, let's have a law that punishes the woke DAs and Judges for letting these serial offenders back out to re-offend over and over. Until judges and DAs are able to be held legally accountable the major cities will never be safe.
