The document I linked above states:

Unless they change that (which as of now they have not) it is as it states it is. In fact, if you downloaded the pdf linked above or even on the page I linked to you would see this on page 2:

DATES: Effective date: This rule is effective on May 11, 2023. Comment period for solicited comments: Comments on expanded applicability in maritime context identified in Section V of this preamble must be submitted on or before [INSERT DATE 30 DAYS AFTER DATE OF PUBLICATION IN THE FEDERAL REGISTER]. The electronic Federal Docket Management System will accept comments before midnight eastern time at the end of that day.

Note the date isn't there because it has not been published yet... Read it again.

I have read it several times. Effective date means effective date, as far as I know. Publication date could mean anything. Let's see what happens.
