Trump used to be the 45th president, he still is, but he used to be, too.
I’m not a lawyer, but it may be a tense technicality due to stating the “facts” of the indictment.
As in, if you were indicting Chris Christie for Bridgegate or whatever, you might phrase it as “Chris Christie was the Xth Governor of New Jersey” because that’s the position he held at the time of the criminal act. Christie still is the Xth Governor of NJ (idk what number he is), but he’s no longer serving as the Governor.
