The prosecution isn't supposed to have secret evidence at a trial. Thank God, the Judge actually knows the law.
Today's ruling didn't affect any evidence.
It was a conversation about evidence. In fact, it was a conversation about an upcoming conversation about evidence.
Since this is a trial about classified information, there will be evidence withheld.
CIPA or the CLASSIFIED INFORMATION PROCEDURES ACT is the law that dictates how trials about secrets occur. There's a section that allows the government to submit a summary of a document, not the document itself.
You have to have a hearing on this and show cause to the judge.
She issued a more significant ruling last month
CIPA also has a section where the defendant has to say what classified information they will be using in defense.
Smith wanted to have that hearing in December. She's delayed it to March. Legal folks are thinking that means the may trial date may get pushed back.
Trump originally asked for an April 20th, 26th trial date. When that was rejected he asked for the trial to be held after the November 2024 election.
So basically, this shady AF character Jack Smith will get to submit a “written summary” of what a document SUPPOSEDLY says (just like hiding behind redactions on a document that we’re just SUPPOSED to believe are being redacted for a VALID reason) and Jack Smith gets to substitute that summary-provided-by-his-side type of evidence as a substitute to the raw data / evidence.
This stinks to high heaven - no different than the FBI lying out their asses to obtain unjustified FISA warrants to spy on innocent citizens.

The summary needs to get approved by the judge who gets to read the original document.

That sounds a little better. Thank you for that clarification. But if the judge turns out to be a scumbag (like Ergonan and others), then the judge approving the summary of the redacted info still won’t be any help to Pres. Trump.
