Now when Trump comes back he has full freedom to fix the borders and states cant get in the way. If Biden controls the borders now and can dictate stuff. Then Trump has that responsibility as well.
This almost seems like a battle to unify what a national border is. Is it one large national border or is it a state by state separate border.
Question: whose constitutional duty is it to protect the border? A Presidents.

What if a state facilitates open borders and illegal entry? Thenpresident under his constitutional duty must step in.
TRUMP will already have Comstituional authority and duty to protect the border. This precedent DOES NOT reinforce that.
So then why this scene in this show?
Maybe to force those serving the federal govt to make a choice between the Constitution and Bidens dereliction of duty. Because their implementation of bidens treasonous acts implicates them in the crime. They should have refused these clearly unconstitutional orders. Border security needs to be run jointly by states and national representatives not just by the feds. If we stop having wars we can fund it easily amd conduct it peacefully.
So I agree that it's already a president authority.
I was more speaking of didn't Trump have problems setting up a border when he was in office. I know he got some done but didn't some states and places give him issues? Or am I miss remembering
They didnt. They removed a temporary injunction. Thats all they did. We are falling into the outrage trap and doing it with a flawed understanding of what actually was ruled on at SCOTUS. There was no ruling on a Constitutional issue and that is what is at the root of this. The court cases are still ongoing in the 5th Circuit. This Article 4 question will make its way to SCOTUS eventually.
