Podesta never denied or disputed that the emails were legit. The law states that failure to deny constitutes admission of truth.
Instead of denying, Podesta utilized a distraction technique. They claimed that the source of the information was a bad actor, implying it was bad information and/or the information was irrelevant since it came from a bad actor.
Dispute does not always mean deny. It is the act of engaging in an argument; the argument being that the source of the information was suspect and therefore "why would you believe it?"
It was literally disputed, even if it wasn't denied.
Also, the emails' veracity were never really denied, true; but conclusions drawn from them were.
I was watching for Podesta to deny them; he never did. He said things like, those accusations are being made without thinking about his family and how it would affect them.
