As I see it, Schifty only resigned from his seat in Congress - NOT from his newly elected position of Senator for California.
He fully intends to serve as Senator as soon as the next session begins following the holidays, and probably did this solely to give himself an extended vacation.
Dude - you've said the same thing in different ways and people tried to tell you the answer. If Schiff's election was found to include fraud then there is absolutely a chance that the election would flip to Steve Garvey and Schiff would lose. By virtue of him already resigning his house seat he can't go back to the House. Ergo - he would be out on Jan 3 (start of new CONgress).
Now - one thing everyone is missing here, and I mean EVERYONE...
Schiff was seated as the replacement senator (by Newscum) for Feinstein's remaining time (thru Jan 2). Schiff would NOT be booted out until Jan 3 if there was fraud in his actual election. He is currently NOT serving in his senate seat for which he allegedly won the election on 11/5. He is occupying a dead woman's (Feinstein) seat until Jan. Not that there will be any noticeable difference...
