I just finished watching Tom Fitton (Judicial Watch) on Bannon's Warroom. His take is that although there have been blanket pardon's without the crimes being listed issued before - Ford's pardon of Nixon, for example - their legality have never been challenged in court. Fitton also says that the timing of the pardons leave it up to Trump's DOJ to deliver on them. This means that the actual pardon that gets put down on paper can be determined by PDJT's team and the timeframe for that to happen is up to them as well. He also says the pardons do not preclude any criminal investigations from occurring and also does not excuse those pardoned from being charged - it would be up to them to present the pardon in court and let the court decide their legality and scope. Even if they were deemed legal, the best that could happen to these people is that their names and crimes be made public, even if they don't face criminal justice for their crimes.
Soon, these people won't be able to walk down the street.

So I guess the plan is to charge them and put them through the very public process, and then force them to use their pardon after conviction.
I like it, but it hinges on judges cooperating and the courts are already backed up with real cases. Maybe expand the federal courts first.
Or I hear there might be some extra court capacity at Girmo we could use for these special trials. If we made them PPV, we could help balance the budget too.
As far as I know, Ford's pardon of Nixon was the only preemptive pardon issued and it was never challenged because it was widely accepted that Nixon was guilty. Now, nobody knows what they are supposedly guilty of (well we have a good idea, but you know).
Trump's DOJ should proceed as if these pardons were never issued. Once the first prosecution proceeds, the defense will argue that the person is pardoned and let the issue work its way through the judicial process. It'll likely end up being decided by the Supreme Court anyway. The sooner this plays out the better.

This case also kind of had a blanket pardon. Defendent was given a pardon to try to compel them to give testimony but pardon was rejected by defendant because they did not want to give up their 5th amendment rights.

That still doesnt sound right. You should not be pardoned unless specific crimes are listed. I myself do not believe in these BS pardons. Pardons should only be used for people who were convicted while they were innocent like the J6ers or for people who had huge jail sentances for non violent crimes. Never should a person be pardoned for terrorism, murder, child violence or murder or rape. Only misdemeanor charges should be pardoned. Anything big should not. Like Fauci who killed how many people that ass needs to be executed.
