I hate when judges do that. Cowards, and lazy ones at that. They're basically saying "If I rule with my gavel I'm on the hook, accountable. If they agree, my work can never be countered and I'll never be held to account."
The court has made recent decisions pointing at Congress for ambiguity. Congress continually refuses - case in point Roe. The only thing they overturned was the Court makingn Roe national law, and Courts can't do that. In the decision, they directly told Congress to write a law if they want a law. Congress never bothered, they preferred to make it an election advertisement and failed.
Parties don't want to resolve anything. Hell the DNC even testified in Court they don't choose candidates the voters want, they choose who pays them. And their testimony made it clear as a private corporation they have no duty to care what voters actually voted for when they select a candidate. Thats how little they care about the voters and how much they just want money.
