On X22 he said that the classification that Musk is working under (I don't know if "special government employee" is the correct term or not) is limited by time. I can't remember how much time that was, possibly 120 days if I remember correctly, but he did say it has a defined limit, so Musk would have to step away when that time comes.
Honestly it seems like this is true. Unless they have some sort of legal justification, they might be required to submit Elon through the congressional approval process as a long term employee.
