The SCOTUS specifically avoided the question of whether the Alien and Sedition Acts of 1798 give the President "Commander-in-Chief" authority or not. I believe these acts specifically granted this authority.
There is a HUGE difference between a person acting as President and that same person acting as Commander-in-Chief.
The sticky point is that Venezuela won't take them back, and the prison that they are going to in El Salvador is brutal. They're reasoning is, if one innocent ends up there, it is an injustice. I sort of see their point a little bit. I say give them life jackets and parachutes and drop lifeboats and drop the whole mess all off the coast of Venezuela. Whether they want them or not.
