I really don't see what it matters that they said the lower court overstepped when they're forcing us to take back this piece of crap. So I guess now Trump doesn't have the right to deport anyone, thanks to the Supreme Court. They're pieces of shit.
The application is granted in part and denied in part, subject to the direction of this order.
Of course, given the negligence to the district courts order, with the admission of illegality by the discharged lawyer pleading the case on behalf of the US government, it is to be expected that the SCOTUS will proceed from practical solutions:
Due to the administrative stay issued by The Chief Justice, the deadline imposed by the District Court has now passed. To that extent, the Government’s emergency application is effectively granted in part and the deadline in the challenged order is no longer effective.
So, the dude was shipped off. Bad luck chummy.
The rest of the District Court’s order remains in effect but requires clarification on remand.
Ok, so far so good. I get that .... certain things needs to be fleshed out, especially when federal courts seem to usurp Article II executive power or at least trying to get the oversight on it.
The order properly requires the Government to “facilitate” Abrego Garcia’s release from custody in El Salvador
Is that so? What interest does the US have, and what duty does it have to an illegal, who broke the law, got apprehended after 10 years, after dropping some anchor babies on US soil?
However, it means that facilitate, at the very least IF (and that is a big IF) he ever were to be released from custody of El Salvador to whom he is a subject, he would be allowed to return, be apprehended again? Or is he all of a sudden a LEGAL alien, by juridical FIAT?
and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador. The intended scope of the term “effectuate" in the District Court’s order is, however, unclear, and may exceed the District Court’s authority.
Ok, to ensure that he then is treated by the book, that is a nice form of facilitation. But, can the District court order a person, who is not a US person, but a subject of a sovereign nation, alien to the US, who has been breaking the law of 10 years, including dropping an anchor baby on US soil, who has no legal rights towards consular assistance, all of a sudden is awarded all these privileges?
How about all those Us citizens in foreign jails? Should this now be the impetus to break all these people free? World wide?
In other words, the SCOTUS has brushed this thing off, without resolving it. Lazy MF-ers.
9-0 decision, huh? Well what President Trump ought to do is bring this fellow to the USSC, physically, and dump him in the chamber, being such a good upstanding citizen as he is portrayed, then they should let him just wander around the court room while proceedings are taking place. How quickly would they order a bailiff to intervene?
He has no right to be here
He's a citizen of El Salvador
What is it with these criminal law-breaking loving liberal leftists?
that's one more vote they'll have to cheat on... they're already busy enough!! kek
The "key" point is that a considerable number of the leadership of the left are now on record as supporting this criminal!
