This is the 1996 Clinton law that Obama used to deport 5.3M. Once they are marked for expedited removal, their 5th Ammendment due process is reduced to a conversation with an ICE officer (Thuraisiaganim 2020).
Section 302 of IIRIRA (codified at 8 U.S.C. § 1225(b)) authorizes expedited removal, allowing immigration officers to deport certain undocumented immigrants without a hearing before an immigration judge.
As of the end of June this year [2019], the backlog had risen to 945,711 cases, and the average wait for a hearing was two-and-a-half years.
In an attempt to reduce this backlog, Trump is expanding the use of expedited removal proceedings to the full extent authorized by section 302(b) of the INA, i.e., to an alien —
“who has not been admitted or paroled into the United States, and who has not affirmatively shown, to the satisfaction of an immigration officer, that the alien has been physically present in the United States continuously for the 2-year period immediately prior to the date of the determination of inadmissibility….”
Aliens in expedited removal proceedings who establish a credible fear of persecution or torture, are entitled to an asylum hearing before an immigration judge, which can include consideration of withholding of deportation under Section 241(b)(3) of the INA and torture claims under the Convention Against Torture (CAT).
Moar from Grok:
Of the 10–12 million undocumented immigrants, only a small fraction (~1–2%, or 100,000–200,000 annually) apply for asylum, and 10–15% of those (10,000–30,000) are granted, equating to <0.3% of the total population.
I wish I could upvote this 1000 times. They have severely undercounter the number of "arrivals", probably because they are handing out green cards automatically for many of the "arrivals".
President Trump 45~47 is doing his Constitutional Duties. Even though the progressives have forgotten that Clinton, Bush, and Obama used this same law to deport millions.
Most of Obama's and Biden's numbers of deportations were driven by turn-around deportations at border entry points. Don't fall for the lie that Obama and Biden made similar effort as Trump.
Applicability. The provisions of paragraph (2) shall apply to any alien who is not admitted or paroled into the United States and who has not been continuously present in the United States for at least 2 years immediately prior to the determination of inadmissibility.
So, if they have been here for 2 or more years - what then?

Here's a little sauce to go with this:

Otherwise, they are deported.

Wow! Thanks for sharing LW! 👏
what the fuck is a credible fear of persecution? they are here illegally - all they have to do to stay is be scared of being made to leave?
That would be a credible fear of persecution in their own country.

Incredible find eitherblue! ✨👏
I wish we were in the millions by now during the current admin. There's 30+ million here illegally.
I distinctly remember back around 2005 that Numbersusa estimated the number of illegal aliens living in the U.S. at approximately 45 mil.
I think we have been manipulated to severely underestimate that population of illegals including visa overstays.
I wouldn't doubt it. Unless we have portal guns it's gonna take a massive effort to get us free of them

I loathe the marxist-democrats and their lies.
In my view, RINO conservatives lies are no less loath worthy. In fact they may be more deserving of hatred.
They pretend to be out friends while stabbing us in the back. At least the marxist-democrats come at us head on.
Yeah they want due process to leave but not to come in... what a bunch.

Funny. All 30 Million illegal immigrants will claim that they fear persecution or torture upon their return.
Credible.....just because you say so or....and I love this one....my husband will beat me, is not a reason for asylum.
