The enforcement and adjudication of Administrative Laws rests within the Executive Branch. Due process in Administrative Cases are nowhere near as stringent as criminal cases.
Due process for wetbacks is the opportunity to show an immigration judge:
American birth certificate
valid visa
valid green card
member of a refugee class allowed to stay.
No proof, --> deport
The cases will never be complex like a case in John Grisham novels. Basically, they need to convince the judge they are not a wetback; very simple. Actually, their due process is not much different than what is required to enter the country at an airport or border crossing.
