He was brought in as an SGE. A "special government employee". These are people who are not government employees and who are taken on temporarily in order to provide their particular expertise in a matter.
That way, the government can benefit from their experience and knowledge of certain matters (like efficiency).
But since they are not official government employees, whose job comes with things like background checks and whatever specific criteria is involved in qualifying for that job, along with the matter of potential conflicts of interest when one's "real job" conflicts with the federal government work they are doing, they are constrained, by law, to a limit of working only 130 days or fewer in a 365 day period. This is not a new law. Musk and Trump knew all about it when Musk was brought on. (Well, I should hope they would have known that basic little fact, anyway. If AP News knew about it, I sure as shit would hope the President of the United States would know about it.)
I don't know if anyone remembers, but there was some hoopla a while back about Trump claiming Musk was "head of DOGE", which as a special government employee and not a federal employee, he can not be, by law. Also Musk had made claims about working in DOGE permanently for Trump's entire term. Which, again, by law, he can not be. (I have absolutely no idea why he would think he could stay the entire term.)
I knew it was going to cause all sorts of excited speculation when Musk eventually had to leave (again, because of federal laws), just because of him saying he would be staying on full time.
I'm pretty sure I caught a 3 day "dooming" ban back when he originally said that- because I was trying to tell people that he couldn't stay on for Trump's entire term because of federal laws.
So, figures, I get a ban for "dooming" when I told people he wasn't going to be staying on for the full term, no matter what he says. And look, I was right!
And I 100% won't be surprised if I get another "dooming" ban when I try to stop people from believing there is some shady super secret conspiracy going on with him "suddenly and mysteriously" leaving DOGE. 🙄
Exactly. Also - people conveniently forget this was known from day 1 - AND - about a month ago Both Trump and Elon said Elon was stepping down late May or early June.

We must be vigilant against click-baiting fake news on all sides, even supposed MAGA sites. And we must tame our biases, else we are no better than the enemy we claim to fight.
