Treason is very, very difficult to prove especially for foreign agents, dual citizens, non citizens, and those that have intentionally NOT executed a proper Oath of Office specifically to avoid a death sentence. 2384 Seditious Conspiracy is easier to prove and can include foreign agents and/or enemy combatants, regardless of oath status.
"Supposed to have allegience to the United States" is easily neutralized by a charged party signing an affidavit claiming allegience to UK, for example (or maybe Kenya?).
The current legal references indicate that the military cannot try cases of treason by the UCMJ. Civilians are not subject to it, and a different crime is specified in the UCMJ. Treason must be tried by the civilian courts. (Trial by tribunal may have happened in Washington's time, because the civilian courts had not then been established.)

I think it's a crazy wide range of possible sentences. 5 years jail and $10,000 fine is a slap on the wrist for these criminals.
That is the MINIMUM allowed. The sentence could be life+10 years and a billion dollars fine.
