You really need to stop spraying "treason" around like it is DDT. It is so often used inappropriately, and you just set yourself up for disappointment when the real crime is charged, tried, and convicted.
You can say it all you want, but you may need to be happy with espionage. Or seditous conspiracy. Many things being called "treason" are simply not. It doesn't mean there are no other crimes to cover the situation.

Accused escape hatch is just a signed affidavit saying "I have no loyalty to the United States because..."; One can be effectively guilty of a treasonous act, but convicted under other statutes or treated as an enemy combatant (in certain circumstances) which might actually be worse for the accused.
