I'm not convinced this will deter these kinds of people, they don't seem to be motivated by consequences for their actions. The penalty is "nothing" if they don't ever get caught or convicted in court.

I'm more for the "lets make an example out of them so this never happens again" penalty.
This is the only way the deterrence effect will actually stick awhile.
