Why would a civilian judge have any say on a military issue?
Blatant seditious speech is not free speech - it is sedition and calling for open rebellion among the military. Kelly should be court-martialed.
The federal judge is basing his authority that Kelly’s freedom of speech was violated. The deeper issue is whether Kelly’s free speech ended where advising military members to disobey orders of the Commander in Chief began.
It will be an issue for higher courts as to whether Kelly was exercising free speech or crossed a line.
