The Foreign Intelligence Surveillance Act (FISA) of 1978 is a U.S. federal law that establishes procedures for the physical and electronic surveillance and collection of "foreign intelligence information". It authorizes surveillance to thwart terrorism, counter espionage, and protect national security. FISA established a special court (FISC) to review government requests for surveillance warrants.
What FISA Does and Key Details:
Surveillance Authority: Authorizes electronic surveillance, physical searches, and the use of pen registers/trap and trace devices to gather foreign intelligence. Targeting: Focuses on foreign powers and agents of foreign powers, including non-U.S. persons located outside the U.S..
FISA Court (FISC): Operates under a specialized court, which reviews applications for surveillance to ensure compliance with the law and the Fourth Amendment. Section 702: A highly debated, controversial provision that allows the government to target non-U.S. persons outside the U.S. to acquire foreign intelligence, which can include incidental collection of Americans' communications.
Warrant Requirements: Requires the government to show probable cause that the target is a foreign power or agent.
Oversight: FISA operations are subject to oversight by all three branches of government.
