Because legislators at all levels think they can make law that supersedes the Constitution. Ultimately, these laws would, in a fair judicial world, be deemed unconstitutional and thus unenforceable. In this, and in many other cases, the process is the punishment. Only the unjustly accused pays because the agents of the state and the judicial officers have immunity for unlawful acts done in their official capacity.
